Fairness in Unemployment Act - Amends the Supplemental Appropriations Act, 2008 to revise the formula for determining if a state is in an extended benefit period.

Modifies the threshold rates of unemployment that must be met by a state in order to establish eligibility for Tier-4 emergency unemployment compensation (EUC) for such state.
