Restoring the Partnership for County Health Care Costs Act of 2009 - Amends titles XVIII (Medicare), XIX (Medicaid), and XXI (State Children's Health Insurance Program) (SCHIP) of the Social Security Act (SSA) to allow benefits under such titles for persons in custody in a public institution pending disposition of charges.

States that, in the case of an otherwise eligible individual (or eligible spouse of such an individual) who is in custody pending disposition of charges, any benefits under SSA title XVI (Supplemental Security Income) (SSI) which are otherwise otherwise payable shall: (1) be withheld until the individual is no longer either in custody pending disposition of charges or an inmate of a public institution; or (2) be paid to the individual's estate, if the individual dies before the pending charges are disposed of or while the individual is an inmate of a public institution.
