Expressing the sense of Congress that the Secretary of Health and Human Services should promulgate as expeditiously as possible regulations required under the Public Health Service Act, relating to protections for residents of certain facilities with respect to the use of restraints and involuntary seclusion.

Calls for the Secretary of Health and Human Services to promulgate as expeditiously as possible the regulations required under the Public Health Service Act that would: (1) require facilities dealing with individuals with mental illness to ensure that there is an adequate number of qualified staff to evaluate patients, formulate treatment plans, and provide active treatment measures; (2) require that appropriate training be provided for the staff of such facilities in the use of restraints and any alternatives to the use of restraints; and (3) require that such facilities provide complete and accurate notification of any deaths occurring after restraint or seclusion of a patient.
