Farm Animal and Research Facilities Protection Act of 1990
Farm Animal and Research Facilities Protection Act of 1990 - Amends the Food Security Act of 1985 to create a new subtitle on protection of farm animal and research facilities.
Prohibits, with regard to any animal facility, foreign or interstate action to commit or attempt to commit specified acts, including: (1) stealing or releasing any animal; (2) vandalizing or stealing property; (3) breaking and entering to destroy, alter, duplicate, or obtain records, data, equipment, or animals; or (4) receiving or concealing material, equipment, or animals with knowledge they have been stolen.
Sets forth criminal penalties. Allows the Secretary of Agriculture to involve law enforcement agencies in a reported offense.
Directs the Secretary and the Attorney General to jointly conduct a study on domestic and international terrorism on animal research, production, and processing facilities and all other facilities in which animals are used for research, food production, or exhibition.
Gives U.S. district courts jurisdiction over cases arising under the subtitle. Allows a private right of action for damages, costs, and fees.
Prohibits interpreting this Act to affect or preempt any Federal or State law or regulation.
Referred sequentially to the House Committee on Judiciary for a period ending not later than Oct. 27, 1990 for consideration of such provisions of the bill and amendment as fall within the jurisdiction of the committee pursuant to clause 1(m), rule X.
