Fair Election Act - Prohibits States from using any device to abridge or deny the right of an individual to be placed on, or to have such individual's political affiliation placed on, a ballot or similar voting materials in a Federal election.

Allows States to impose specified prerequisites regarding petitions for placement on ballots. Allows States to waive such requirements for candidates or political affiliates which receive certain amounts of votes in the most recent election for President or the Senate.
